Constitutional Mandate

PSETA as a public entity within the ambit of the Department of Higher Education and Training (DHET) derives its Constitutional mandate from Section 2 read with Schedule 4 of the Constitution which lists education at all levels, excluding tertiary education as a functional area of concurrent national and provincial legislative competence.

Skills Development Act

SETAs are established in terms of Section 9 of the Skills Development Act. The Minister may, in the prescribed manner, establish a sector education and training authority with a constitution for any national economic sector.

Public Service Education and Training Authority

The Public Service Education and Training Authority (PSETA) is one of the 21 Sector Education and Training Authorities (SETAs) established in accordance with the Skills Development Act No. 97 of 1998 (SDA). Between the year 2000 and 2009, the PSETA reported to the Department of Labour but has since been transferred to the new Department of Higher Education and Training.
